A petition challenging the election of Nairobi governor Mike Sonko has been struck out.

While dismissing the petition on Tuesday, Justice Msagha Mbogholi ordered the two petitioners to pay Sh5 million costs.

Mbogholi said it was clear the petitioners Japheth Muroko and Zacheus Okoth did not want to carry on with the case any longer.

He declined an application from the two seeking withdrawal and said they had not followed the right procedures.

The two petitioners failed to show up in court on Monday for the hearing of the case.

Mr Muroko claimed he could not make it to court over alleged death threats he had received.

They on Tuesday applied to withdraw the case but the court rejected their application saying hearing dates were set earlier in December last year on strict terms.
