Nyaribari Chache member of Parliament Richard Tong'i has a reason to smile after Kisii High court on Monday morning dismissed the application of scrutiny and recount of petitions challenging his re-elections.
According to the court, the petitioners did not provide sufficient evidence that would amount to voter recount.
The three petitioners Chris Bichage, Zaheer Jhanda and James Kenani through there lawyers argued that due to public interest there was a need for voter scrutiny as they said that affected the outcome of the August pols.
The case, however, is ongoing despite the first win from the MP side.
Tong'i won the recently concluded pols with a small margin that saw a number of petitions challenging his victory.
Speaking outside the courtroom Tong'i said he is confident that he will emerge victorious.
