A home caretaker was on Friday charged in a Nakuru court with maliciously evicting his tenant and without notice. The court heard that Lukas Mukasa, 47, a caretaker of a three-bed roomed house located in Makao estate in Nakuru town, on November 11 this year out of malice and with no notice of six months as required by Kenyan laws, forcefully evicted one Alex Masinde who also is his cousin from a house that belongs to their relative who lives abroad. The prosecution said that on that at around eight o’clock that evening, the accused had confronted the complainant at the gate of the house and ordered him not to enter the compound or face his wrath. He claimed that the complainant was misusing the house by entertaining prostitutes and drunkards and that he would not allow him to enter the compound again. According to the prosecution, the accused went inside the house and closed the gate and ordered his children to close the gate that leads to a servant quarters room that had been occupied by the complainant. The court heard that the accused had been requested by the complainant’s father who happens to be the uncle of the accused to allow him use the room for a few months as he sort himself financially, a request he had agreed to unconditionally. Resident magistrate Patrick Mwaniki was told that the complainant was forced to seek help from friends who offered him a place to sleep and food and that for the next one week he failed to access his house and gain services including cooking, sleeping, taking birth and changing clothes. The magistrate heard that the complainant who works at Menengai Soap Company was forced to apply for a leave to avoid his employment being terminated. The accused denied the charges and was released on a cash bail of Sh50,000. The case will be heard on December 18.
