Wiper leader and NASA’s presidential running mate Kalonzo Musyoka is a happy man after the high court ruled that suspension of his foundation (Kalonzo Musyoka Foundation) by the non-governmental coordination board was illegal.
The foundation’s operations were suspended and its accounts frozen mid last year by the board citing suspected money laundering and operation of illegal accounts activities, after it had failed to account for sh. 196 million in their coffers.
Justice Roselyn Aburili in her ruling stated that the directive by the Fazul Mohamed led board was illegal, null and void.
“In this case the directive was issued indefinitely and as such even if the complainant filed an appeal before the cabinet secretary, there was no time to be heard therefore the only help then could come from the court,” the ruling read in part.
Details also emerged that the board had given the foundation a go ahead for operations 3 weeks prior to the suspension, and did not give an explanation for the sudden change of plans.
This was in contravention of the NGO act which provides 14 day notice in advance before implementing the directive.
