The High Court in Kisumu has dismissed a case that was filed by an Independent candidate Florence Aluodo challenging the election of Christine Ombaka as the Siaya Woman Representative.

Justice David Majanja ruled that due process was not followed in serving other parties in the case.

The Court said the petitioner failed to duly serve the defendants in the case including the electoral body.

The ruling follows an application by lawyer Jude Ragot representing Ombaka, that the case be dismissed on technicalities.

Ragot welcomed the court ruling noting that the petitioner failed to adhere to the court process, Monday.

“It is good the court made a wise ruling in the case,” said Ragot.

IEBC lawyer Maureen Odek also hailed the ruling.

Ombaka did not hide her joy following the dismissal of the case noting that she will now start serving the people of Siaya.

She said the case was defective from the start and thanked her lawyer for the great work.

“Today I am happy and will immediately start serving the people o Siaya, this case was weighing me down but now it is off my shoulder,” she said.

The petitioner had requested the court to nullify the election of Ombaka on grounds of irregularities.
