A resident of Ndeiya ward in Limuru sub-county won a land case against the county government of Kiambu after five years of being in the corridors of justice.
Paul Muchiri won the case after a judgment was given by Limuru Senior Resident Magistrate G.H. Oduor in his favour, a case he began in 2009.
Muchiri had told the court that Ndeiya plot number 34 near Makutano market belonged to him, and was not the property of the then defunct Limuru county council as alleged.
The case had Muchiri as the accused and a former councillor Philip Kaniaru as the first defendant and the Limuru county council (now Limuru sub-county government) as the second defendant.
Magistrate Oduor in his five page ruling said there was politics that went into the accused losing his land, and investigations did reveal that the land was rightfully his since there was no documentary evidence showing change of ownership.
In addition, evidence presented revealed that in the year 2007, the accused and defendant were contestants of the same councillor’s seat in Ndeiya.
Magistrate Oduor said in the time the case was before the court Muchiri showed adequately that the land was his property.
After the ruling, Muchiri said he was happy that justice had been served.
