Public servants interested in running for political seats have until the end of today Tuesday to hand in their resignations.

According to the public service code of conduct, public officers have been barred from seeking any political position while still in service.

A number of public servants including Cabinet Secretaries, Permanent Secretaries, heads of government agencies, parastatal chiefs and teachers are expected to quit their jobs at least six months prior to the August 8 polls.

However, a Kericho resident has filed a case against the code.

Eric Cheruiyot is contesting the rule and accused the Independent Electoral and Boundaries Commission (IEBC), the Attorney-General, Public Service Commission (PSC), and Head of Public Service Joseph Kinyua of acting contrary to the Constitution.

Cheruiyot claims that the laws illegally grant senators, governors, members of parliament and MCAs unfair advantage by allowing them more time in office while their competitors are expected to stay out of service.

According to Cheruiyot, the court should force public servants to resign only after the dissolution of County Assemblies and Parliament.

The case will be heard on Monday.
