Opposition leader Raila Odinga is off the bait after Supreme Court quashed a petition seeking to punish him for boycotting the October 26 fresh presidential election.
The International Institute of Governance and Pokot South MP David Pkosing had moved to court to have the former prime minister charged with treason arguing that the boycott move by Odinga amounted to sabotage.
The plaintiffs wanted Odinga to be charged with treason.
The legislator wanted the Supreme Court to affirm President Uhuru Kenyatta's victory by declaring that he was legally elected.
Supreme Court judges however dismissed the petition saying it did not challenge the declaration of Uhuru Kenyatta and William Ruto as president and deputy president elect respectively.
"The matter does not fall under the purview of presidential petitions," the Chief Justice noted.
CJ Maraga explained that the court would however consider the case at a later date.
"If this court loses focus and succumbs to pressure to allow all petitions, it will not be able to determine them within stipulated timelines. We decline to grant the prayers but the matter will be heard after the determination of the two petitions before us," he added.
Maraga said the court will rule on the presidential election petition by Monday.
