Attorney General nominee Kihara Kariuki is yet to vacate his office as Appeal's Court president despite President Uhuru Kenyatta reaffirming Kenyans, reports the Sunday Nation.

A source within the Judiciary intimates that Kariuki has been going on with his businesses with the motive behind his delayed stay in office linked to Uhuru's plot to take control over JSC.

"You will be surprised that Kihara has not been vetted. So he continues in his position as Appeal's Court president when he is a nominee to AG position.

"There is something to it and it has something to do with influencing positions to JSC," says the source.

Unlike when Uhuru announced nomination of Keriako Tobiko to cabinet, where he announced his resignation, he did not however report whether or not Kariuki had resigned.

Judiciary Register Ann Amadi, said she could not tell whether or not the experienced judge had tendered his resignation.

"Resgnation normally goes to the appointing authority which is not us. Ours is usually to recommend for the appointment," she says.

But Kihara's continued stay in office has been linked to Uhuru's plot to have him influence nominations top JSC as he seeks to 'fix' the Judiciary.

Sources intimate that Uhuru wants Justice Mohammed Warsane dropped from JSC as Appeals Court representative along with having Martha Koome replace Kihara as the president.

To effect the interests, sources say, Kihara could therefore stay longer before he is formally vetted as Githu Muigai's replacement.
