After his confession that IEBC cannot guarantee a credible election, chairperson Wafula Chebukati has come under pressure from a section of leaders who want the repeat polls postponed.

Chebukati’s confession came after commissioner Roselyn Akombe resigned stating that the current commission cannot hold a fair election after the Supreme Court order.

According to regulation 64 of the Elections (General) Regulations 2012 the Chairman of the Independent Electoral & Boundaries Commission and the Returning Officer of the presidential elections, with the power to adjourn the presidential elections.

The law states that the power to adjourn can and should be exercised if the presidential elections are clouded by legal uncertainty.

The clause adds that the polls can be postponed if there is a likelihood of being interrupted by riot, violence, shortage of equipment or other materials, and administrative difficulties.

Additionally, no law has been gazetted to govern the procedure for the conduct of the fresh presidential elections.

NASA leader Raila Odinga has already announced that he will not take part in the poll cited lack of reforms in IEBC.
