Despite losing governorship following appeal's court ruling on Friday, Machakos Governor Alfred Matua also lost Sh10 million that he had been awarded by the High Court early this year.
At the High Court, his rival Wavinya ndeti, was slapped with Sh10 million by Justice Aggrey Muchelule which Mutua was due to receive.
But the judgment by Justices William Ouko, Mohammed Warsame and Gatembu Kairu successfully overturned the burden to Mutua who is to pay on top another Sh2.5 million to Ms. Ndeti.
Further, Ms. Ndeti will receive another Sh2.5 million from the Independent Electoral and Boundaries Commission which was also a respondent in the case.
"The 3rd respondent shall pay the appellants costs of this appeal, to be taxed but not exceed Sh1million," read the judgment.
The Sh 1 million adds to the Sh1.5 million that Dr. Mutua was ordered to pay as costs incurred by Ndeti at High Court.
In their ruling, the three judges further ordered IEBC to conduct elections in strict conformity to the rule of law.
"We direct IEBC to organise and conduct a fresh gubernatorial election in Machakos County in strict conformity with the constitution."
