Justices Mohamed Warsame, William Ouko and Gatembu Kairu on Friday directed the Independent Electoral and Boundaries Commission (IEBC) to pay a total of Sh2.5 million to former Kathiani MP Wavinya Ndeti.
They issued the order after Ndeti won the petitioned she filed against Machakos Governor Alfred Mutua at the Court of Appeal.
Mutua too, was ordered to pay the same amount to Ndeti following the ruling.
The governor has, however, appealed against the ruling.
He maintained that the Judges misunderstood the findings of the case.
“The 3rd respondent shall pay the appellants costs of this appeal, to be taxed, but not to exceed Kshs. 1,000,000.00,” the judges said.
The Judges ordered for a free and fair elections in accordance with the constitution.
The ruling came after former Kathiani MP Wavinya Ndeti moved to court to challenge Mutua’s win in 2017 citing massive illegalities and irregularities.
“We direct IEBC to organise and conduct a fresh gubernatorial election for Machakos County in conformity with the Constitution, the Elections Act and the Regulations,” the judges said in the ruling.
Mutua has, however, remained unfazed despite the loss of the case. He has also insisted that he will still contest for Presidency in 2022.
“We are appealing this decision and in the meantime, I am still the governor of Machakos and I am the fifth president of Kenya, by the will of God. I urge the people of Machakos to remain calm as we work on this,” Mutua said.
