[Photo/zipo.co.ke]Opposition chiefs Raila Odinga and Kalonzo Musyoka have vowed that their swearing-in on Tuesday will go on as planned.Both their supporters and opponents have been wondering who will swear in the two as people's president and deputy president respectively.However, a NASA insider has revealed that the controversial ‘oath’ will be administered by a judge."We have two patriotic Kenyan judges ready to administer the oath of office for the two as President of the People’s Assembly," the insider told Sunday Standard.The remarks come a day after Chief Justice David Maraga said he could not direct a magistrate or judge not to preside over the event since it is not within his mandate to dictate to them what to do."As the Chief Justice, I have no authority to direct any judge or even a magistrate on what to do. The independence of the judiciary is so sacrosanct that the CJ is not given power to direct the officers on what to do,” said Maraga on Friday.The Constitution outlines that for one to swear-in as president, the ceremony must be presided over by the Chief Justice but NASA ruled out Maraga in their January 30 event."We will not use the Chief Justice because we have taken the route of where Kenyans were exercising power directly," the insider added.Echoing same sentimemts, Siaya Senator James Orengo hinted that a judge could swear in Raila and Kalonzo since the Chief Justice cannot prevent them from doing so."Did you hear Maraga talk yesterday? He said he cannot stop any judge from swearing in Raila Odinga and it is because he knows there are no legal grounds to prevent Raila from being sworn in as the president of the Republic of Kenya," Orengo said on Saturday, as quoted by Sunday Standard.
