The Supreme Court will either uphold President Uhuru Kenyatta’s re-election or call for another election. One of the key factors that will influence the verdict of the court is rejected votes, Nation reports.
The court will take into account the rejected votes to determine whether President Uhuru met the 50% + 1 requirement. If the President does not meet the requirement after the rejected votes have taken into account then the nation will automatically go back to the general election.
This is after Independent Electoral and Boundaries Commission chairman Wafula Chebukati declared President Uhuru Kenyatta the winner of the August polls. Uhuru garnered 8,223,163 against his closest rival Raila Odinga’s 6,822,812.
Secondly, the seven judge’s panel will also determine whether there were anomalies in the elections, and, if so, whether the inaccuracies are massive enough to lead to the nullification of the August Presidential election. The court will uphold the election if the inaccuracies will not have much impact on the outcome.
Thirdly, the court will also look at different sets of results and disparities in votes garnered by the presidents, governors and senators across the nation. If the outcome of the various contests does not add up then they are likely to overturn the election of President Uhuru.
