With a looming constitutional crisis in the country, Bungoma senator Moses Wetangula says National assembly Speaker Justin Muturi should take over in the event elections are not held before November.
The Apex court of Kenya annulled President Uhuru Kenyatta’s victory thus subjecting him and opposition leader Raila Odinga for another poll within 60 days.
Although IEBC has set October 26th as date for repeat poll, Odinga’s team has maintained that it will not allow elections without certain terms.
“I was disappointed to see Githu Muigai misleading the public. It clearly shows that he doesn’t read the constitution,” he said, in reference to Muigai’s sentiments that Uhuru will still be in charge.
He added:”Careful interpretation of the constitution clearly shows that speaker on the National Assembly will take over for 90 days ahead of another repeat poll.”
The constitution, Muigai said, did cannot allow anyone to set government without its provisions, adding that the sitting president will be in charge until a new one takes over.
Senior Counsel James Orengo had on Wednesday hinted that in the event of a constitutional crisis, Uhuru’s term will come to an abrupt end since he will have to pave way for transitional government.
