Opposition leader Raila Odinga could yet again be forced to go to Supreme Court despite early indications that he would not should Uhuru Kenyatta be declared President-Elect.
Provisional results put Uhuru at pole position to be reelected with a strong 54 percent of votes to Odinga’s 44 percent.
But Odinga, who dismissed results in the IEBC portal, is expected to make an announcement on Thursday should Uhuru be declared winner of the elections.
Owing to the fact that NASA tallying centre results puts him on the lead, should he be announced president by his team, the act may not hold waters given the constitution of Kenya.
The constitution dictates that any aggrieved party in presidential elections to seek legal address, a reason why NASA could yet again end up in corridors of justice.
Only the Chief Justice of the Republic of Kenya is allowed to swear a President and he will do so based on results by the electoral body IEBC.
In 2013, Odinga went to Supreme Court to challenge election of President Uhuru Kenyatta although his basis was dismissed.
