New details have emerged on the intrigues that preceded court’s decision to invalidate the outcome of the August presidential results.
According to the Standard, two of the judges had already agreed on upholding the election whereas two were against it.
The two judges who were undecided had to spread themselves thereby making it a tie of 3.3 compelling the Chief Justice David to initiate a vote on conscience.
The judges had no choice but to turn off their phones as intense lobbying was going on. One of the judges allegedly faced off with a delegation from one of the respondents.
On the day of the ruling, one of the star lawyers representing one of the respondents did not appear at the court because of reasons yet to be disclosed.
The lawyer allegedly found it tough to come to terms that he has lost one of the most crucial cases in the history of this nation, Jubilee operative revealed that the lawyer knew nothing would change by Thursday before the ruling was made.
“We knew we were done in by Thursday evening. There was no point (of turning up at Supreme Court),” said the source, as quoted by Local Daily.
In his ruling, David Maraga has to prepare Kenyans for the best but at the same time hinted the worst for one of the respondents.
“Before I read the determination, I want to say this. The greatness of a nation lies in its fidelity to its constitution and its strict adherence to the rule of law, and above all, the fear of God,” he said.
