Kenya could plunge it a serious constitutional crisis should IEBC fail call for a meeting between Jubilee and NASA principals over elections, says lawyer Nelson Havi.
Already IEBC has set October 17th as the date for presidential elections repeat, a move that has been opposed by opposition NASA.
Only the ODM leader Raila Odinga, he says, has a hand to determine whether elections will be held on the scheduled date.
“IEBC should open eyes and see this impending crisis. Supreme Court ruling of 2013 gives Odinga and avenue to boycott elections, a move that will lead to constitutional crisis,” he says.
He further says:”even the 2017 scenario gives a room where any Kenyan can move to court and seek inclusion of anyone who wants to contest. The ultimate solution is dialogue.”
Constitutionally, elections are supposed to be held within 60 days after the Supreme Court ruling, a move which could lead to inevitable constitutional crisis.
Both parties have held tough stands, a move that has led to major concerns from Kenya’s allies especially the US.
