Regardless of his tough conditions to IEBC over presidential elections repeat, ODM leaders Raila Odinga may after all decide whether or not Kenya will go for elections, says lawyer Moseti Moseti.
It is rumoured that IEBC may be compelled to postpone elections from October 17th to a later date due to inadequate preparations.
But Moseti says previous Supreme Court rulings and the constitution gives Odinga powers to push for more radical reforms in the IEBC.
“To some extent he holds key to our elections. Supreme Court ruling of 2013 actually dictates that he must be on ballot. Should he boycott, the elections will be declared null and void.
“And even more recent ruling of 2017, it insists a fresh election but IEBC has secluded other candidates. He can still move to court to block the elections or challenge their legality,” he says.
The ruling whose judgment is due on Wednesday puts a precedent that would compel IEBC to allow interested parties to participate in a fresh election under article 138.
Among the changes Odinga wants in the commission is resignation of CEO Ezra Chiloba and revocation of contracts awarded to Al Ghurair printing company.
