Independent electoral and Boundaries Commission lead lawyer Paul Muite could after all be in trouble with his clients following his Saturday’s concession.
In a request made by NASA lead Counsel James Orengo to have all presidential original forms scrutinized by the court, Muite said the commission was in a position to deliver the request.
However, his counterpart Issa Mansour opposed the request adding that it would take time for the commission to deliver the forms and allow NASA to access IEBC servers due to time constraints.
On Monday, the court is set to make a major ruling over Orengo’s application and it could strengthen or weaken Raila Odinga’s case.
Similarly, President Uhuru Kenyatta’s lawyers’ led by Ahmednassir Abudullahi opposed the application by NASA saying it would amount to compelling IEBC to give them evidence contrary to the court’s decision.
The request if allowed would compel the commission to defend a number of inconsistencies hence changing the dimension of the case.
But lawyer James Orengo said his side was ready for the case but pleaded with the court to allow him scrutinize information as relayed by IEBC.
