A 19-year-old man was today acquitted at the Milimani law court in Nairobi two days before the new year.
According to Milimani law court Senior Magistrate Martha Mutuku, the accused was deemed innocent for lack of enough evidence to press charges against him as the plaintiff failed to turn up to in court.
It was a sigh of relief for Enock Chitwa who was accused of robbery with violence at Silanga in Kibra in Nairobi.
According to his charge sheet, the youngster was apprehended by police in possession of a pistol. He allegedly assaulted and robbed two victims.
“By the fact that the complainants should be in this court today and have failed, this case lacks substantial evidence for its hearing and determination. I hereby declare Enock Chitwa free and this case is closed,” said Magistrate Mutuku.
Chitwa, who is a resident at the sprawling slum of Kibra, line Saba Nairobi County, would have spent the New Year’s Eve under the police custody and afterwards spend many years behind bars if he was convicted of a crime that holds the death penalty.
