A new twist has emerged after the High Court directed that a case against Kisumu Senator Fred Outa and Ruth Odinga be transferred to Busia law courts.
This prompted an adjournment on the hearing of the case charging them with disrupting an IEBC training and destruction of property.
The alleged crimes were committed last year, a week before the repeat presidential polls.
The development came after the Witness Protection Agency (WPA) and the Director of Public Prosecution (DPP) wrote to the court seeking to have the case moved to Busia citing the security of the witnesses.
Justice Thrispisa Cherere of the High Court granted the WPA the orders last month.
Outa and Odinga through their lawyer Geoffrey Yogo protested the fresh orders, claiming that they were unfair and unconstitutional.
According to Yogo, the orders ambushed them as they were set for a hearing session.
He further said that they were yet to be served with the ruling a month after it had been delivered.
“My clients should be arraigned before Kisumu court since Kisumu is the locality where the purported crimes took place, it is where the nearest courts are and also is the home to those who are witnesses set to testify against the accused,” said Yogo.
He expressed concern that there could be something fishy with the quality of the witnesses insisting that if they were to true witnesses, they would not fear testifying at home.
Yogo requested that he be given a month to talk with his clients concerning the fresh development and its possible impacts.
Chief Magistrate Julius Ng’arng’ar directed that the case will be heard on the 21st of May when it will be established whether the matter will proceed before the Kisumu court or will be relocated to Busia.
