A top performing School in Baringo County faces contempt proceedings after defying court orders to re-admit six students who had been expelled for alleged indiscipline.

Sacho High School had been instructed by Judge Abigael Mshila of the High Court in Nakuru to readmit the six Form Four students and cater for their accommodation, transport, food and security as they resided outside the school premises after it declined to readmit them as boarders.

On May 6, the judge had also ordered the school to readmit the students immediately but the school went back to court and appealed against the order noting it would cause a substantive loss to them.

The parents to the students had told the court that shortly after the order; they returned their children back to school only to be denied entry at the gate by the security officers.    

They demanded a response for the restriction but the security officer said that they had instructions from the principal not to allow any children in the school.  

According to the parents, they have been paying fees in excess of Sh 200,000 annually thus, by not readmitting the children; the school would be indebted to them.

They asked the court to consider the fact the students were in form four who were preparing for their final examinations and it would greatly affect their revision as there are some practical subjects that would require full attendance of the students in school.  

Through their legal representative, they averred that the expulsion was in breach of the Basic Education Act which prohibits expulsion of students.  

They went ahead saying that the students were denied a fair administrative process which is their right and the school should put the children’s interest paramount.

Judge Mshila slated the hearing of the contempt proceedings on June 6.
