A middle-aged man has been sentenced to serve 10 years in prison by a Nakuru law court for committing an indecent act with a minor.

Harrison Theuri was found guilty of committing the offence on August 13, 2011 at his residence in Bahati, Nakuru County.

Theuri is said to have lured the minor who was nine years old to his house with cookies where he locked the door and undressed himself and the child.

The court heard that the victim had been sent to her aunt's place when she met Theuri who then enticed her to his house.

While testifying alongside neighbours, the mother of the victim told the court that they found the girl in bed at the suspect's house undressed after forcing him to open the door which was still locked from inside during the 8.00pm incident.

A mob attracted by the commotion arrested the suspect who was half dressed and took him to Bahati DC's office before he was transferred to Kiamaina Police Station where he was detained.

Theuri was acquitted on the second charge where he was accused of raping the minor after the court found no evidence linking him to the allegations.

“No medical reports have been submitted to prove rape actually took place but the fact that the suspect had undressed her is in itself an indecent act that is against the law,” said resident magistrate Judicaster Nthuku on Thursday last week.

The accused who had earlier denied the charges claimed that he was arrested on his way home but failed to prove his version of events as this was not recorded in his statement at the police station, allegations the magistrate said only came to him as an afterthought.

The court was convinced that he committed the indecent act against the will of the complainant which earned him the sentence.

He now has 14 days to appeal against the sentence.
