Peter Kavutha a 37-year-old was on Monday ordered to pay a bond of Sh200,000 in Kithimani Law Court for allegedly raping a 16-year-old girl.
Kavutha who is a resident of Kikumini Village in Yatta sub-county is accused of swaying the 16-year-old as she was on her way from School.
He allegedly led her to his house and later forced her have sexual intercourse with him after he weighed down her strength.
This comes after the parents of the minor went to Court and filed a case complaining against emotional and physical harassment of their child who is underage.
The accused however denied the allegations maintaining that he has never committed such a crime.
However in his ruling, Kithimani Law Court Principal Magistrate Davis Karani stated that the accused will remain in custody as his case awaits hearing in case he fails to raise the bond.
“Minors are protected under the Kenyan Constitution Chapter IV article 53 (d). Child rape is a breach of the Kenya Sexual offence Act and rights to equality and dignity and security of the person under the Supreme Constitution,” said Karani.
The next case mentioning will be in March 25 this year while the date of the case hearing has been set to be in May 11 2015.
