A Mombasa Court on Thursday dismissed a case filed by a Mombasa businessman who was suing Nairobi governor Mike Sonko over a land deal.
The businessman, Mr Mehul Nanadal Shah had moved to court to sue governor Sonko for failing to surrender the land to him.
The court heard that Mr Shah had paid Sonko Sh2 million in 2013 for the land in Nyali, Mombasa but Sonko never surrendered it to him.
Mr Shah who was represented by Dr John Khaminwa, asked the court to order Sonko to pay him Sh240 million saying that the Sh2 million he allegedly gave Sonko had accumulated at 30 per cent annual interest to reach Sh240 million.
Sonko through lawyer Jared Magolo asked the court to dismiss Shah’s suit saying the suit which was allowed by Justice Richard Mwongo in 2013 was time-barred.
Justice Peter Otieno struck out Shah’s suit saying the leave that Justice Mwongo granted Mr Shah to sue Sonko on March 12, 2013, was filed out of time.
