Kenya tea development agency limited has been barred by the high court from signing over 3 billion shilling hydro power projects.

Hydro-power International went to court under a certificate of urgency seeking to have the agency stopped from entering into signing any hydro power projects until a case lodged in court is heard and determined.

In their submission, Hydro Power International claimed the tenders were done contrary to the Kenyan procurement laws and the process was tainted with fraud and corruption.

Phillip Nyachoti who represented Hydro-power international said the tenders were made in favors of Boom System limited and VS hydro limited contrary to the Kenyan procurement laws and that it was full of fraud and corruption.

“The tendering board undermined the requirements for fairness, integrity, and transparency of the tender process by allowing VS Hydro (PVT) limited a late stage of the tendering process,” said Nyachoti

Nyachoti also presented to the court that Kenya Tea development agency proceeded to allow undue advantage to boom systems to introduce other partners at the tender submission stage through joint ventures.

Kenya Tea Development disregard recommendations by its management committee was noted because the company awarded all the projects to Boom systems limited and VS Hydro limited as a joint venture to the detriment of the applicant.
