Head of Delegation for Team Kenya Mr Stephen Soi has been appointed the team's Chef-de-Mission for the 2018 Commonwealth Games.
This is despite Soi facing five counts of theft.
Soi is accused of stealing Sh25 million from Athletics Kenya and NOCK.
He however presented a document in court claiming he had received an email from the Gold Coast 2018 Commonwealth Games Corporation (GOLDDOC) September 8 asking him to get a visa to facilitate accreditation.
He has now asked the court to release his passport document so that he can process his visa in advance.
"As part of preparations for the events, I am required to represent Kenya in the Chef-de-missions' seminar that is set to place in Australia between October 8 and 12," his petition reads in part.
