Nairobi governor Mike Sonko on Monday asked the court to dismiss a petition filed by former governor Evans Kidero against his win.

Sonko through his two lawyers Harisson Kinyanjui and Cecil Miller argued that the the former governor filed the case late and that the application was done through backdoor. 

“My lords we ask you to disallow the application by Evans Kidero, we will suffer prejudice if he is allowed as an interested party... Nothing stopped Kidero from filing the application or election petition within the prescribed time,” Sonko's lawyer Kinyanjui said.

The Independent Electoral and Boundaries Commission (IEBC) also supported Sonko saying Kidero filed the petition through backdoor.

Kidero's lawyer Tom Ojienda argued on favor of Kidero saying IEBC and Governor Sonko would not be prejudiced if Kidero is enjoined in the matter and asked the court to allow the application.

“No prejudice will be suffered by IEBC and Governor Sonko if Kidero will be enjoined in the election petition... My Lord allow us to come into this thing and sort it out,” Kidero's lawyer Tom Ojienda said.

The final ruling by the court will be on Thursday November 16.
