Nairobi governor Mike Sonko has rejected President Uhuru Kenyatta's call in the Nairobi Metropolitan Area Transport order.

Sonko says that the directive given in 2017 was unconstitutional and invalid.

He said that his government was never notified formally of such an agreement in contravention of section 26(5) of the Intergovernmental Relations Act 2011.

“The attempt to comply with section 26(4) of the Inter-Governmental Relations Act, 2011 by introducing a Bill before the National Assembly in the form of the Nairobi Metropolitan Area Transport Authority Bill which was tabled in Parliament in October 2017 was never successful as the bill was preliminarily rejected and as such the National Assembly approval has never been granted,” read court papers in a case filed by lawyer Phillip Nyachoti concerning appointment of board members of the Authority.

Sonko was issuing a response to a case in which KATIBA Institute Director Wanjiru Gikonyo has faulted the notice creating NAMATA since it reduces county revenue.

“The order creates a third party at the table of the division of revenue which isn’t provided for by the constitution,” she stated.
