Speaker Elachi confirms Miguna's fate

Unless the state confirms his citizenship status, Miguna Miguna will not be vetted as the Deputy Governor.

This is according to Nairobi Speaker Beatrice Elachi.

Miguna, a lawyer and formerly Raila Odinga's personal assistant, was deported to Canada after a crackdown on those involved in Nasa Chief Raila Odinga's otherwise illegal oath on January 30.

Elachi said Miguna's nomination is political but that he must be taken through the normal vetting process at the county assembly in an interview with Hot96 on Thursday 17th May. 

Elachi said the embattled city lawyer should not hastily take a plane back to Nairobi following the nomination but rather should let the authorities give a clear position on his citizenship before then.

His nomination shall be endorsed by a simple majority, which is 90 votes and above for the case of Nairobi county which has 127 MCAs. It remains to be seen what will come of the endorsement and vetting process.

"As for now, we know Miguna is Canadian. So, he should not hurry to jump on the plane," the speaker said.

Elachi noted that the process is likely to take between 3-4 months, meaning Nairobi will have to wait until September to have a deputy governor.

"The governor has done what the law allows him. We shall follow the law as we are the ones who make the laws," she said.

Lawyer Cliff Ombeta, who is a member of the legal team fighting for Miguna's return to the country presented the letter to the speaker on Thursday.

Elachi said Miguna's nomination can be attributed to the outcomes of the historic handshake between President Uhuru Kenyatta and Nasa chief and opposition leader Raila Odinga.

"All we read in this move is the fruits of handshake. But as I said, we shall follow due process in all that we do," she said.

Meanwhile, Kiminini MP Chris Wamalwa said Elachi has no powers to determine whether Miguna should be vetted or not. The legislator said the county speaker only serves as an intermediary whose work is to relay the message to the floor of the House once she receives the governor's letter.

"The Committee on Appointments is the one mandated to invite Miguna for vetting. It is there that questions on his citizenship can be raised," Wamalwa said.

Wamalwa pointed out that the differences Miguna had with Sonko during the campaigns should not be used to deny him the opportunity to be vetted.

Sonko needs a neutral deputy who will help him fight cartels that are rendering service delivery impossible to the people of Nairobi.

It remains to be seen how Sonko and Miguna will work if indeed the vetting goes through and Miguna is incepted as the Deputy to Sonko. The differences they had during the hotly contested gubernatorial race. It seems a match made in heaven though. Only that it was never on the cards.
