The man behind the murder of Kenyan freedom fighter Pio Gama Pinto has been awarded 2.5M after proving that he was tortured by the police while in detention. He said that the police squeezed his testicles which resulted in him losing consciousness.
Justice John Mativo directed that Mr. Kisilu Mutiva be compensated 2.5 million. The victim was arrested while having fun with friends at Rwathia Bar after the police linked him to Gama Pinto's murder.
He argued that he was taken to Eastleigh Police Station where the inhuman acts were committed. Mutiva states that his toes were smashed with a rungu and the testicles squeezed as a means of forcing him to confess.
“I am persuaded the petitioner proved to the required standard that his rights were violated by the police, considering the nature of torture meted out to him during the time of arrest and when he was taken to court to face murder charge,” the judge stated in his ruling as quoted by Kenyans.
Mutual was given a death sentence in 1965 but retired president Daniel Moi pardoned him 35 years later.
