ODM aspirant for the Starehe parliamentary seat Mr Stve Mbogo who lost to Jubilee's Charles Kanyi in the August 8, polls has yet again lost a bid to stop the covearage of story concerning a defilement case linked to him.
The case that got the politician jailed fro 20-years by Kibera law courts in 2009 but was released after appealing the decision in the High Court has come back to haunt him.
Mbgo had been accused of defiling a 15-year-old girl at a rented apartment in Kileleshwa on August 3, 2008.
He went to the court seeking to bar The Star, Nation Media, Mediamax and the Standard Media from publishing the story.
However, senior magistrate Davidd Mbeja said Mbogo's application lacked merit since the information is already in the public domain.
"Journalists, unless barred by the court, are entitled to publish a fair and accurate report of a judicial proceeding before any court," said Mbeja.
"Elections are also over and all aspiring candidates for various political positions were subject to public scrutiny," the judge stated.
Mbogo has denied any wrongdoing saying the girl's mother fabricated the claims and demanded Sh500,000 to drop the case.
