The government shall appeal Thursday's court decision that declared deportation of self-proclaimed NRM General Miguna Miguna illegal, Interior PS Karanja Kibicho has said.
Judge Luka Kimaru directed Immigration department to surrender Miguna's passports which had been confiscated, a move that was lauded by lead lawyer James Orengo.
"The ruling means that Miguna Miguna will be back. Nobody can deny him his constitutional rights," he said.
But in a press statement, Kibicho said, Miguna remains an alien adding that the deportation was procedural and 'done in accordance to the law'.
Further, he added, the government shall move to court soonest to appeal against the ruling by the Nairobi court.
"Going forward, the government's legal team handling the matter is currently reviewing the High Court ruling and will shortly be appealing the decision".
For better part of this year, the executive arm of government as been at loggerheads with the judiciary.
