An 18-year-old secondary school student has been sentenced to 10 years imprisonment by a Kisii court for defiling a one and a half-year-old baby.
George Morara who was 16 years at the time of his arrest was found guilty and convicted by Kisii Resident Magistrate Mr Paul Mutai.
The accused who was unrepresented was charged that on June 19, 2014, at Nyachenge location Kisii County, he unlawfully used his fingers to defile the minor.
The prosecutor Ms Cecilia Mosomi told the court that the accused took the girl from her grandmother claiming that he was going to buy her sweets only to defile her.
In their testimony to the court, the girl’s parents said that they found her bleeding when Morara brought her back to them.
The mother testified on behalf of the little girl while the court also relied on a medical report which confirmed that the child had been defiled.
However, the accused dismissed the allegations leveled against him as malicious claiming that the family wanted to fix him due to his differences with the girl’s father over his failure to pay him for work he had done for him, but his defense did not convince the court.
In mitigation, the accused pleaded with the court for leniency saying he is still in school and cannot afford to spend all those years in jail.
The Magistrate said the prosecution had proved the case against him beyond a reasonable doubt. The accused was given 14 days to appeal.
