IIt is a sigh of relief by former Garissa sub county commissioner, Dominic Kyenza after Chief Magistrate Margaret Wachira said that the charges levelled against him be dropped.
In her ruling, Wachira dismissed the charges under section 2006 of the criminal procedure code for non attendance of the complainant and the witnesses.
Also acquitted was Kyenza's storeman, Abdullahi Shariff.
The two were accused by the Ethics ana Anti Corruption Commission (EACC) of fraudulently acquiring 270 bags of rice meant for relief food using the name of a childrens’ home and other special needy schools within Garissa sub-county.
Addressing the press outside the law courts after the ruling, a delighted Kyenza said that he was happy that the case is finally out of his way.
Kyenza who has been in service for 40 years said that all along he knew the charges will not stand the test of time.
The former administrator who was flanked by his lawyer, Evans Nyasani, his family and friends thanked all those who supported him.
