Supremacy battle at the Supreme court has once again resurfaced with the new standoff involving the Chief Justice Mr Willy Mutunga and his deputy Justice Kalpana Rawal.

The discontent emerged after Mutunga revoked a directive delivered by Justice Ndung'u Njoki in a case surrounding the retirement of Tunoi and Rawal.

As this unfolds, Mutunga has also been accused of intimidating and harassing his juniors at the highest court in the land.

In a petition filed by Isaac Madubwi, the CJ has allegedly been faulted for limiting the independence of other judges working under him at the supreme court. 

The petition also seeks to have the Judicial Service Commission (JSC) form a tribunal to get into the intricacies surrounding Mutunga, with the intention of ejecting him out of office before the dawn of his retirement as stipulated by the constitution.

'It is quite unfortunate and surprising that the Chief Justice has persistently acted with scant regard to the rule of law hence bringing disrepute to himself, the judiciary and the entire legal profession," Read Madubwi's document in part.

According to Mr Madubwi, CJ Mutunga ought to have adhered to the Supreme Court Act which indicates that orders issued by any other Supreme Court judge can only be challenged and changed by a 5-judge bench.
