A case filed at the Supreme Court seeking to have Opposition leaders Raila Odinga and Kalonzo Musyoka jailed presented by jubilee leaders failed to start this morning after IEBC and NASA failed to file their responses.

Jubilee party the other day went to the Supreme Court suing the Opposition leaders for contempt of court.

According to Jubilee, the Supreme Court ordered the IEBC to hold a fresh election within 60 days in accordance with the constitution.

Rahael Tuju,Secretary General Jubilee party, wrote a document arguing that Raila Odinga withdrew from elections, failed to sign form 24A and also  been trying to prevent elections.

According to Kenyans.co.ke, part of the jubilee document quoted that “Raila Odinga has since written to the commission on his withdrawal from the fresh poll and has publicly declared that such repeat elections will not take place as per the date gazetted by the IEBC. It should be noted that as it may, he has failed to supply the Commission with the requisite Form 24A, which is the legal instrument for a candidate’s withdrawal”.

However, this morning NASA leaders were still looking for the team to represent the party in the court.

On the other side, IEBC said that they had been going through a busy schedule planning and organizing the fresh elections throughout the country.

Tom Macharia who is jubilee party lawyer noted that the case was urgent and they require attention as quick as possible and registar told them that the parties would be notified on the hearing date.

Deputy Registrar of the Supreme Court, Daniel Ole Keiwua, stated that the file would be placed before Deputy Chief Justice Philomena Mwilu who will decide the bench to hear the case.
