Lawyer Nelson Havi now says that the highest court in the land,the Supreme Court,is a disadvantaged institution.
Speaking on Citizen TV Sunday,Havi said that the Chief Justice David Maraga-led court is still battling suspicion from a section of the nation making it the most powerful yet lest believed as compared to athe lower courts.
He said that some of the court's former judges have been implicated in graft dealings putting into test its integrity.
''The Supreme Court is a very disadvantaged court as it has itself through its judges been at one point implicated in corruption putting into consideration the fact that one of its former Judges Justice Phillip Tunoi was implicated in a 200 Million shilling corrupt dealing,'' said Havi.
He also said that the opposition block under the now defunct CORD coalition foul cry regarding the 2013 post election petition judgement is likely to hinder the court's believability with regards to the Presidential petition filed by the opposition under its new NASA outfit.
NASA has worsened the situation alleging that the court was one sided in the 2013 petition and has urged it to use this year's petition to redeem itself in the eyes of Kenyans as it seeks to overturn President Uhuru Kenyatta's re-election.
Havi now says that the court has to adopt a new way to ensure that it's judgement regarding the petition erases it's bad reputation and is taken in by all Kenyans.
''Each judge has to be allowed to independently spell out the reason for his judgement unlike in 2013 when a collective judgement was made,'' he said explaining that that will rule out any suspicion of influence from external quarters especially the executive.
