Political scientist Mutahi Ngunyi has accused the Supreme Court judges of staging a civilian coup, following their decision to invalidate President Uhuru Kenyatta’s win in last month’s general election. Mr Nyunyi, who correctly predicted the outcomes of the last two general elections, said history will judge the Supreme Court judges harshly, for overturning the will of 15 million Kenyans. “The ruling by the ‘Maraga 4’ was not just a civilian coup in my view, it was an act of high treason, it was an act of mis-engineered justice, it was an act of subversion. An act to overthrow the will of the people using technicalities,” the political scientist said in his weekly YouTube analysis of political events. “And this is why history will not be kind to the Maraga 4,” Mr Ngunyi said, referring to Chief Justice David Maraga’s colleagues at the court, who voted to nullify the presidential result. Two judges — Njoki Ndung’u and J.B Ojwang — dissented. “History will judge them harshly, and the harshness will be delivered only slowly, painfully and in small installments.”Ngunyi and his team of analysts faulted judges Isaac Lenaola, Philomena Mwilu, David Maraga and Smokin Wanjala for not giving any reason for their decision to overturn the election. The dissenting judges gave their arguments for their decision.“They did not have the reasons. They only had the end in mind,” one analyst argues. The political scientists accuse the courts of being used to help Raila ascend to power through the back door. “This political decision is meant to result in a constitutional crisis. And the end game is a caretaker government. Period,” another analyst concludes.
