It was only time before the ruling of the Supreme Court to nullify the presidential elections in August.

This came into play on Wednesday, when a petition against Kajiado Governor Joseph Lenku was mentioned.

In the petition, former Olkejuado County Council Chairman Taraiya ole Kores and Benjamin Tipatet argued that some statutory forms had not been dully filled by presiding officers and their deputies.

Through their lawyer Ochieng Oginga, the petitioners argued that the IEBC did not follow the constitution in announcing the final results.

However, Ole Lenku and IEBC lawyers argued that it was not a mandatory in law that the forms need to be signed.

The petitioning team referred their argument to the Supreme Court ruling on September 1, when a similar scenario led to the nullification of the presidential results.

Justice John Onyiego also invoked the Supreme Court decision in regard to the failure to sign statutory forms and sought Mr Khaseke’s views on the same.

The verdict on the case will be delivered on January 25.
