Lawyer Moseti Moseti claims the decision by Supreme Court to grant NASA orders to access IEBC ICT servers could prove detrimental to the case.

Filed by Counsel James Orengo, the opposition said access to the servers will help them prove their case challenging election of President Uhuru Kenyatta beyond reasonable doubt.

And with unconfirmed reports indicating that IEBC is yet to honour the orders, Moseti says the servers would allow NASA authenticate all statistical transactions during and before voting.

“These kind of judgments are quite serious and since the servers stores all transactions, any manipulation and illegal entry will change the direction of the case.

“It is an advantage to NASA and if used well, the Supreme Court may have another additional evidence to deal with at the end of submissions,” he further says.

In the ruling, Judge Isaac Lenaola however limited the access to Read Only Memory which Moseti claims will still work to NASA’s advantage.

A tweet by lawyer Paul Mwangi of Raila Odinga on Tuesday morning however claims the commission is yet to abide by the ruling.
