The accused Philip Omollo, however, denied the charges before Chief Magistrate Esther Maina for the offence allegedly committed in May 25 this year in Otonglo, Kisumu County.

The court heard that on the material day, the accused had been hired to cut grass around a shop in Otonglo Market when a customer came to the shop with the bicycle.

The customer is said to have parked the bicycle on the shop’s pillar before excusing himself to visit a toilet.

The Prosecution Desk told the court that the accused on seeing that the customer was taking a bit long, he allegedly took the bicycle to his home only to return to the scene after 20 minutes to find the owner asking around for the bicycle.

The Prosecution Desk added that the complainant was later told that Omollo was seen with the bicycle, claims the accused vehemently denied.

This prompted the complainant to report the matter to Police who conducted a search at Omollo’s residence where the bicycle was recovered.

Omollo who was arrested following the incident, however, told the court that he had no idea how the said bicycle gained access to his compound therefore he should be released.

He was released on a cash bail of Sh5,000 with surety of a similar amount pending the hearing of the case in June 17, 2015.
