Paul Okoth, however, denied the charges before Kisumu chief magistrate Esther Maina for the offence allegedly committed on diverse date between January last year and May this year.

Okoth also faced a second of conducting business illegally without a licence from the relevant authorities. He also denied the charge.

The court heard that the accused was arrested on Sunday at his home in Ojolla, Kisumu, selling illicit liquor to his customers.

During the arrest, other revelers at his home were also nabbed they have been released on bail awaiting their date in court.

Additionally, his brewing containers were also confiscated by the police.

Okoth is believed to have been arrested on several occasions but in return ends up being set free on bond, and for this reason the prosecution applied that he be remanded as the prosecution builds up a case against.

The application was turned down by the magistrate.

“Everything here depends on the available evidence, therefore I cannot grant the prosecution its request because there is no enough evidence for me remanding the accused,” said Maina.

Okoth was released on a cash bail of Sh5,000 with a surety of a similar amount pending the hearing on May 25.
