A man suspected to have stolen a motorbike from Kisian area in Kisumu failed to take a plea when he appeared in court on Thursday due to injuries resulting from mob justice.
Kisumu chief magistrate Lucy Gitari ordered the prosecution to take Moses Omwalo to hospital to seek medical attention as he was visibly in a poor state.
The prosecution, however, said that the accused will be fine as he was taken to hospital on Tuesday following the mob justice incident.
Gitari dismissed the application even as Omwalo complained of pains. He is expected to return to court after healing his wounds.
Police rescued Omwalo on Tuesday when he was subjected to mob justice after allegedly being caught red-handed trying to steal a motorbike from the market.
The crowd was baying for his blood ready to burn him when the police arrived on the scene.
The police are said to have had a rough time trying to disperse the rowdy crowd that had vowed to teach him a lesson. Omwalo is said have been taken to the Kisumu East district hospital for treatment.
Cases of motorbike theft are said to have risen in the area over the recent weeks and locals had laid traps to catch the culprits behind the theft.
