A court in Eldoret has dismissed an application by the prosecution seeking to deny bail three suspects accused of abducting and defiling two form four girls from a school in the outskirts of Eldoret Town.

In her ruling, Eldoret Principle Magistrate Harison Barasa said the reasons given by the prosecution were not compelling enough to warrant continuing keeping the suspects in custody.

The prosecution had told the court that the suspects if released, would interfere with witnesses as well as endanger their own lives considering members of the public had vowed to kill them.

However the suspect's lead lawyer Stanley Kagunza opposed the application saying his clients were not a flight risk.

"The prosecution has not provided compelling reasons to deny the suspects bail. This application is hereby rejected," said Barasa.

The three were released on a Sh300,000 bond and a surety of a similar amount.

The three, Anne Njeri, Paul Githinji and Peter Maina were arrested two weeks ago in Limuru while allegedly escaping with the two 17-year old girls to Nairobi.

They, however, pleaded not guilty to charges of abduction, illegal confinement, defilement and committing an indecent act with a child.

The case will be mentioned on November 1, 2017.
