A Mombasa court has freed three men accused of acquiring Sh20 billion from a businessman fraudulently. 

The Director of Public Prosecutions (DPP) withdrew the charges leveled against the three; Paresh Shiviji Parbat, Shivji Jadava Parbat and Victor Arara Were on grounds that the case lacked adequate evidence. The three had been taken to court for allegedly channeling the late Premji Jina Manji Pindolia’s ordinary shares worth the said amount between between April 14, 2002 and January 31, 2006 in Mombasa. Appearing before Mombasa Senior Resident Magistrate Edgar Kagoni, Principle State counsel Jami Yamina said the DDP wanted the case quashed because the police conducted shoddy investigations into the matter. “The DPP has, therefore, directed the Director of Directorate of Criminal Investigation to form a team from Mombasa and Nairobi to investigate complex fraud involving the six companies cited in the case,” said Jamii, as quoted by the Standard. The defense team led by lawyers Ngachaku Gakui and Jared Magoloo objected the directive to withdraw the case, arguing that the DPP has undermined the rights of the complainant. The team insisted that the suit can go on before it is determined whether the accused have a case to answer or not.
