A Nakuru court on Friday ruled against a case seeking for the reinstatement of a teacher accused of having a love affair with his student.According to a local daily, the court declined to compel the Teachers Service Commission to reinstate Hezron Silunya, a former teacher at Moi Girls’ High School Eldoret following his suspension. 

In his ruling, Employment and Labour Relations Judge Steven Radido said that the suspension of Silunya complied with the laws of the land, adding that the teacher’s rights were not violated.

The ruling comes after the teacher was suspended before being transferred to another school over alleged misconduct while in the line of duty. 

“The court is satisfied that the process undertaken by the TSC was in compliance with the law. Silunya’s rights were not violated, “he ruled.The commission has been presented with a series of letters allegedly signed by parents seeking for the reinstatement of the teacher. 

Silunya was found with a case to answer after the commission sent two investigations to probe the matter.

He was accused of being immoral by engaging in a love affair with his students. 

The teacher is said to have used cunning ways including buying foodstuffs and gifts to lure the students into his trap before the affair came into the public domain.

Silunya, however, denied the allegations leveled against him upon completion of investigations.

He went to seek an order to bar the commission from transferring him arguing that his constitutional rights were being trampled upon.
