The defilement case against a Njoro Girls High School teacher will now be mentioned before another court following the sacking of the magistrate handling the case.

Paul Gicheri, 52, a Kiswahili teacher at the school is accused of defiling a 15-year-old girl.  He also faces five counts of sexually abusing other girls from the same school.

Gicheri allegedly altered marks of the students for sex.

Chief Magistrate Doreen Mulekyo who initially took the case, disqualified herself from hearing the case in August on the grounds that the conduct by the prosecution had made it hard for her to maintain her objectivity.

“The history of the conduct of the matter has made it impossible for the court as trial magistrate to maintain the objectivity required of me and for this reason I disqualify myself from further hearing of the matter,” she said.

Mulekyo said she was disgusted and disappointed by the way the prosecution kept amending and substituting the charge sheet which did not provide a way forward to the court.

Senior Principle Magistrate Bernard Ndenda took over the case and was ready to proceed but he was sacked by the Judges and Magistrates Vetting Board (JMVB) over alleged financial impropriety and poor writing skills.

Ndenda was among eight magistrates found unfit to continue serving in the judiciary.

On Thursday, Senior Resident Magistrate Judicaster Nthuku directed that the case be mentioned on October 12 before a plea court for directions on court allocation and fixing of a hearing date.

 The suspect was released Sh200,000 cash bail and told to report to OCS at the Njoro Police Station every Friday.
