[Capital FM]The Supreme Court on Monday identified several issues for upholding the victory of President Uhuru Kenyatta following the October 26 repeat presidential poll.However, the biggest task that is left for Chief Justice David Maraga and his team is to convince those opposed to the Monday decision that it was based on merit.Opposition Nasa has already faulted Maraga's ruling saying that the judges were 'under duress and intimidation' and that Nasa doesn't 'condemn them, but sympathize with them'.So, what are the issues that the judges will be explaining in 21 days?First is the question of whether or not the Independent Electoral and Boundaries Commission was compelled to hold fresh nominations for the fresh presidential poll the court ordered for on September 1.Second, will be whether the 60 days the commission had to organise and hold the poll was sufficient for them to conduct said nominations.Another issue for determination by the court will be what the effect of a declaration of invalidity of the presidential election under Article 140 of the constitution was.Fourth, the court will also deliver its findings on the impact of Nasa leader Raila Odinga’s withdrawal from the race, and whether the withdrawal was indeed valid."What is the legal effect of the withdrawal of a presidential election candidate before election?" Maraga stated on Monday as quoted by Capital FM.Fifth, the court will rule on the constitutionality of the amendments made to section 83 of the Elections Act by the Jubilee party in response to its annulment of the August 8 presidential poll.The sixth issue set for determination is whether the petitioners Harun Mwau, Njonjo Mue and Khelef Khalifa, if indeed they did not vote in the October 26 poll, could legitimately fault the IEBC’s conduct of a poll in which they did not participate and therefore speak from an authoritative standpoint.Finally, the court will also rule on the legal consequences of not holding an election in each constituency as was the case on October 26.
